We kindly ask you to review and sign our Conditions of Sale prior to making your purchase. It is essential that you, your installer, and any other agents involved are fully informed of the unique logistical and technical considerations associated with the purchase, delivery, and installation of Zellige and Natural stone Mosaics.

This document serves as a binding contract, so please read it carefully. Should you have any questions or require clarification, do not hesitate to contact your dedicated Tiles of Lucca associate for assistance.

Verification of Quantities

As a courtesy to our clients, once a design has been selected, our associates can provide preliminary takeoff quantities for estimation purposes only. Upon request,  we may, try to contact the installer directly to confirm the final required quantities for each item.

It is the responsibility of the buyer’s, tile installer or general contractor to provide required quantities prior to purchase. Tiles of Lucca will not be liable for any discrepancy of excess or shortage on orders.

Product Information

Tile Variation

All tile products are subject to variation in shade, size, and appearance. All measurements are nominal.

Product Characteristics

  • Tile and stone are not warranted against chipping, crazing, cracking, or wear after delivery.
  • Handmade and machine-made tiles may include irregularities in size, shape, color, warpage, moisture absorption, surface finish, texture, and dynamic coefficient of friction. These characteristics are inherent to the manufacturing process and contribute to the unique appearance of the products.

Sealing Requirements

  • All stone and crackle-glaze ceramic tiles must be sealed.
  • Crackle-glaze tiles must be sealed prior to and after grouting. When used in wet areas, sealing is required to minimize water penetration and potential discoloration.
  • Crackle glazing will continue to develop over time. For proper maintenance, resealing is recommended every 3–6 months during the first year and every 6 months thereafter.
  • Sealing does not render crackle-glaze tile waterproof nor prevent moisture migration into the clay body from the back or sides. Darkening of the clay body and crackle lines, particularly in light glaze colors, may occur. Crackle patterning will naturally vary.
  • Porcelain tile should not be sealed unless specifically noted.

Natural Stone

Stone is a natural material and will vary in color, tone, and veining. Variations from samples, displays, and within a single shipment are to be expected. Natural features may include veining, shading, inclusions, chips, pits, fossils, or other unique characteristics. No two pieces are identical.

Order Quantities

  • A minimum of 20% additional material is recommended for all tile orders to allow for cuts, waste, and breakage.
  • For tiles 18" x 36" and larger, a minimum of 30% overage is recommended.
  • Additional material should be ordered with the original purchase. Subsequent orders may vary in appearance or may no longer be available.

Slabs

  • Slab measurements provided prior to shipment are approximate and intended for estimating purposes only. Actual slab dimensions will be confirmed upon receipt. Slabs may be larger or smaller than the estimate provided.
  • Sales orders will be revised to reflect actual square footage, and any balance due or credit will be processed prior to shipment.
  • Zellige Tiles Characteristics: Zellige tile is a handmade material with unique variations on color, size including chips, cracks and crazing, such characteristcs should be expected and accepted by the customer.

  • Natural Stone Characteristics: Stone is a natural material with unique variations, including veining, markings, shading, inclusions, chips, pits, fossils, and other features. No two pieces are identical. Expect color variation from samples, displays, and within shipments.

  • Order Recommendations:

    • For all tile products, we recommend ordering at least 15% overage to account for cuts, waste, and future repairs since these are made-to-order products.

    • To ensure consistency, we recommend purchasing additional material with the original order, as subsequent orders may not match in shade or size, or the product may no longer be available.

 

Payment Terms for Custom/Special Order Materials

1.   Payment Requirements:

    • Full payment is required at the time of purchase for in-house production and all custom/special orders.

2.   Cancellation, Exchange, and Return Policy:

    • Custom and special orders cannot be cancelled, exchanged, or returned under any circumstances.

3.   Sales Tax:

    • The sales tax reflected on the sales order is an estimate and may change based on applicable tax codes in effect on the shipment date.
    • The purchaser is responsible for any increases in sales tax.

4.   Pricing for Add-On Orders:

    • Add-on orders will reflect the current price of the item at the time the new order is placed.

Storage Fees

  • Stocked Merchandise: Paid-in-full orders will be stored free of charge for up to 8 weeks after order placement. Beyond 8 weeks, storage fees of $100 per pallet/slab per month will apply.

  • Custom/Special Orders: These orders will be stored free of charge for up to 4 weeks after production completion or material receipt. Afterward, a storage fee of $100 per pallet per month will be charged. Storage payments must be made at the beginning of each month.

  • Tiles of Lucca may extend storage duration at its sole discretion. Communication  via email will be sent for overdue storage. Failure to respond timely will result in forfeiture without reimbursement.

Shipping Policy

  • Shipping Carrier: All products are shipped via common carriers, or by buyer’s carriers not by Tiles of Lucca owned vehicles. Lucca is not responsible for any damages during transit in EX Works term.

  • FOB Terms:

    • Shipments of Tiles of Lucca merchandise are EXW Englewood, New Jersey.

    • All other shipments are FOB point of origin. Ownership of goods transfers to the buyer at the point of shipment, in accordance with FOB terms.

  • Delivery Scheduling: Orders will not be scheduled for delivery until payment is received in full and all required signatures are completed.

 

Scope of Work

Tiles of Lucca is not a contractor and does not perform or contract for the installation of any product.

As a courtesy to our clients, Tiles of Lucca can provide an installation guide for our collections. This installation guide is informational purposes only and Tiles of Lucca cannot be held liable for providing such information.

 

Freight and Delivery

  • Freight Charges: Freight and handling charges are added to all Sales Orders and Invoices.

  • Missed Deliveries: If you or your designated representative are unavailable to accept a scheduled delivery, a re-delivery fee will be applied and must be paid before arranging the replacement delivery.

FOB Inspection Requirements

1.   Box Count Verification:

    • Verify the box count upon delivery and note any discrepancies directly on the bill of lading before signing.

2.   Inspection Upon Delivery:

    • You and/or your on-site representatives (e.g., general contractor, subcontractors, installer, or anyone responsible to the property owner) must open and inspect all merchandise fully upon delivery to the job site.

3.     Inspection Upon Delivery

    • Any visible damage must be documented on the Bill of Lading prior to signing. Photographs of the damage must also be taken at the time of delivery.

4.     Failure to Report Damage

    • If damage is not noted on the Bill of Lading at the time of delivery, the client will be deemed to have accepted the shipment "as is." In such cases, no claim can be filed, and the carrier will not accept responsibility.

5.   Reporting Discrepancies or Damage:

    • Any concealed damage or discrepancies discovered after delivery must be reported to both the carrier and Tiles of Lucca in writing within 48 hours of delivery.
    • Tiles of Lucca will file a claim with the carrier for damages reported within the 48-hour window using the pictures and documentation provided.

6.   Client Responsibility:

    • Tiles of Lucca is not responsible for claims denied due to the client’s failure to report within 48 hours or negligence in noting discrepancies on the bill of lading.
    • If replacement material is required due to unnoted discrepancies or late claims, the client will be responsible for the replacement costs.

7.   Reimbursement Policy:

    • If the claim is accepted by the carrier and a refund is issued, Tiles of Lucca will reimburse the client for the amount received from the carrier or replace the tiles.

 

Returns and Cancellations for Tile

1.   Order Cancellation:

Once the order is placed with the factory for custom orders are non-cancelable and non-refundable.

2.   Returns/Refund:

    • Tiles of Lucca doesn’t accept returns of any kind including overages; All sales are final.
    • Installed material is non-refundable. Full or partial installation of the product constitutes acceptance of the material.
    • Materials that have been hand-selected or “cherry-picked” are not eligible for return or refund.
    • Slabs, custom/special order products, setting materials, and accessories cannot be returned or canceled.
    • Materials designated as discontinued, lot sale and marked as final sale at the time of purchase are not eligible for return, cancellation, or exchange.

 

Warranties

Due to these products being handmade the factory doesn’t offer any warranty. 

Tiles of Lucca assumes no responsibility beyond the price paid by the customer for the materials received. The Terms & Conditions outlined herein supersede any terms provided by the customer through purchase orders or other agreements.

Delays

Tiles of Lucca shall not be held responsible for delivery delays resulting from causes beyond our control, including but not limited to acts of God, strikes, accidents, border or customs delays, traffic, natural catastrophes, pandemics, or other unforeseen circumstances.

Additionally, Tiles of Lucca reserves the right to delay the processing of an order until the order form and/or credit card charge receipt have been duly signed.

 

Credit Card Charges

By accepting this order and the accompanying conditions of sale, I hereby authorize Tiles of Lucca to debit the bank account provided or charge the credit card specified for the full amount of the sales order or invoice agreed upon by both parties. All payments are for the items and services outlined herein.

I further authorize the automatic withdrawal of funds from my account by Tiles of Lucca on the transaction date. In the event that an ACH transaction is rejected due to non-sufficient funds (NSF), I understand that Tiles of Lucca may, at its sole discretion, attempt to re-process the charge within 7 days or charge me a cancellation or rejection fee.

I acknowledge that the origination of ACH transactions to my bank account must comply with U.S. law. I certify that I am an authorized user of the credit card or bank account and agree not to dispute the payment with my Credit Card Company or Bank, as long as the transaction aligns with the terms specified in this order and the Terms and Conditions of sale.

This Agreement shall be exclusively governed by the internal laws of the State of New Jersey, without regard to conflict of law provisions. Any suit, action, or proceeding arising from or related to this Agreement must be commenced and maintained exclusively in the Superior Court of the State of New Jersey, County of Bergen, or in the Federal District Court for the District of New Jersey, Newark, New Jersey. Both parties consent to the jurisdiction and venue of these courts.

Service of process in any such suit, action, or proceeding will be deemed sufficient and binding if served by certified mail to the addresses provided at the beginning of this Agreement. The prevailing party in any such proceeding, or in any action to enforce the terms of this Agreement, will be entitled to recover its costs, including reasonable attorneys' fees, incurred in connection with such proceedings.

Deemed agreement:

 Buyer is required to accept the terms and conditions in this agreement, if you wish to decline any terms and conditions, you must expressly reject this notice and the agreement prior to making any payment or deposit. In the case of payment or deposit is made, you will be deemed to automatically accepted the terms and agreement.
